Apple victory over Samsung in Australia

Apple Got a Win with Samsung and Android in Australia recently

Recent patent which could profitise shut down selling of any Android device in Australia. Truly this is one of the best gifts that ever Steve Jobs may have given to Apple. Steve Jobs had more than three hundred patents on his name, and one of them may be implementable for shutting down the sales of every Android device in Australia’s market.

The Jurisdiction of Australia recently granted Apple an interim injunction on the sale of the Samsung Galaxy Tab 10.1, in Australia over allegations of the disuse of two patents by Samsung. Now Florian Mueller says that the patents in remark are very broad, and aren’t specific to only Galaxy Tab 10.1 but also to other such devices. They could very well be used to any Android device which uses touch screen.

If Apple wins the case at the end, it could sue any Android device manufacturer and prevent it from selling any Android device in Australia.

Even if Samsung wins this lawsuit, it’s unlikely that it will be able to do it in time for the holiday season, which means a lot of lost sales for Samsung.

The ruling gave in favor of Apple could also have some impact on the decision of the U.S. court, which is expected to announce its decision soon.

Samsung, the most popular Android device manufacturer has been on the receiving many patent lawsuits at the end likely. It recently agreed for pay licensing fees to one of the major IT Grabber Microsoft for every Android device sold in the U.S.

Google hasn’t been much able to defend its hardware partners at all, despite acquiring just Motorola for $12.5 billion, primarily for its patents.

Samsung has dropped lawsuits over Apple for the infringement of several patents in many other countries whose words are yet to be known,…Hope atleast they come in favour in Samsung to protest its declining sales among android devices so that It doesn’t loss its place among other android devices producing companies.

Apple yet to face court injunctions to stop sales of its new iPhone 4S as Samsung claims it breaches patents of its own.

Apple's new iPhone 4S faces the sale protest of court injunctions in France and Italy from the Korean based electronics firm Samsung, which claims that phones breach patents it owns on wireless tele communications.It is an boostup of the war between Samsung and Apple, who are fighting a numerous of increasingly hot court battles in various territories around the world. Samsung, which is striking a challenge Apple for the title of the world's biggest manufacturer of smartphones, says it plans to file preliminary injunctions in Paris and Milan on the basis that the iPhone 4S, announced in California on Tuesday night and expected in a number of countries including the UK from 14 October, infringes its patents on WCDMA technology.

The iPhone 4S combines both GSM and CDMA tele communication systems – the two principal ways of connecting to mobile networks from a mobile or other enabled device – in a single phone, so that it can be used on almost any mobile network in the world without any modification. Apple has been selling a CDMA version of the iPhone 4 since January, initially for use on the US Verizon network, though it is not sold in neither France nor Italy, which uses GSM networks. Samsung filed a suit against Apple in the USA in April claiming infringement of its WCDMA patents.

"Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology, and we will steadfastly protect our intellectual property," Samsung stated in a public statement.

The South Korean company did not say when the French and Italian filings would take place, but did say it plans similar moves in other countries "after further review". Under the laws of France and Italy, companies can seek and courts can order a ban on sales of a product even before the product reaches markets, Samsung spokesman James Chung told Reuters.

Apple did not have any comment at the time of publication.

Samsung is set to report sharply lower quarterly earnings on Friday on persistent declines in chip prices, while investors look for signs that its telecom business could sustain its booming growth. Samsung has been a supplier to Apple of parts including touchscreens and memory chips, but the two companies have also been at odds through the courts since April, when Apple took legal actions claiming Samsung's Galaxy line of smartphones and tablet computers, claiming that they copy its iPhone and iPad.

Samsung has responded by taking Apple to court over what it alleges are violations of its patents covering wireless communications. Samsung said the technology it claims Apple infringes "is essential to the reliable functioning of telecom networks and devices" and that it sees the alleged violations as "too severe and that (the) iPhone 4S should be barred from sales".

Apple has won sales injunctions against Samsung products in the Netherlands and Germany and is seeking one in Australia. Samsung has asked a court in the Netherlands to stop Apple from selling iPhones and iPad tablets in that specific country  previously.
